Southwest Florida Fishing and Spearfishing LLC ("Southwest Florida Fishing and Spearfishing," "we," "us," or "our") operates the website at swflspearfishing.com (the "Site"), publishes video content on YouTube, and sells branded merchandise. This Privacy Policy explains what information we collect, how we use it, and the rights you have under U.S. federal law and the laws of the State of Florida, including the Florida Digital Bill of Rights (FDBR).

By using the Site or purchasing from us, you agree to this Privacy Policy. If you do not agree, please do not use the Site.

1. Information We Collect

Information you provide directly. When you place an order, contact us, or sign up for updates, we may collect:

  • Name, email address, shipping and billing address, and phone number
  • Order details and purchase history
  • Account credentials, if you create an account
  • Communications you send to us

Payment information. Payments are processed by our third-party payment processor (Stripe). We do not store full credit card numbers on our servers. Stripe receives your payment details directly and handles them under its own privacy policy and PCI-DSS compliance.

Information collected automatically. When you visit the Site, we may automatically collect:

  • IP address, browser type, device identifiers, and operating system
  • Pages visited, referring URLs, time on site, and clickstream data
  • Cookies, pixels, and similar tracking technologies

Video viewing data. Videos embedded on the Site are hosted by YouTube (Google LLC). When you interact with an embedded video, YouTube may collect data about you under Google's Privacy Policy, including via cookies, even if you do not click play. We do not control that data collection.

2. How We Use Your Information

  • Process and fulfill merchandise orders, including print-on-demand fulfillment and shipping
  • Communicate with you about orders, customer service, and support
  • Send marketing emails or updates if you have opted in (you may unsubscribe at any time)
  • Operate, maintain, secure, and improve the Site
  • Detect and prevent fraud, abuse, and security incidents
  • Comply with legal obligations and enforce our Terms of Service

3. How We Share Your Information

We do not sell your personal information for money. We may share information with:

  • Service providers who help us operate the Site and business — including Stripe (payments), Printful (merchandise fulfillment), Supabase (data hosting), email providers, and analytics providers
  • YouTube/Google through embedded video players
  • Legal authorities when required by law, subpoena, or to protect the rights, safety, or property of Southwest Florida Fishing and Spearfishing or others
  • Successors in the event of a merger, acquisition, or sale of assets

Some of these arrangements (such as analytics or advertising cookies) may be considered "sharing" or "targeted advertising" under certain state laws, including the FDBR. You may opt out as described in Section 7 below.

4. Cookies and Tracking

We use cookies and similar technologies to keep the Site working, remember your cart, understand how the Site is used, and improve performance. You can control cookies through your browser settings. Disabling cookies may limit functionality, including checkout.

5. Children's Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 in violation of the Children's Online Privacy Protection Act (COPPA). If you believe a child has provided us personal information, please contact us and we will delete it.

6. Data Retention and Security

We retain personal information only as long as necessary to provide our services, comply with legal obligations (including Florida tax and recordkeeping requirements), resolve disputes, and enforce our agreements. We use commercially reasonable safeguards to protect your information, but no system is 100% secure.

7. Your Privacy Rights

Florida residents (FDBR). If you are a Florida consumer covered by the Florida Digital Bill of Rights, you have the right to:

  • Confirm whether we process your personal data and access that data
  • Correct inaccuracies in your personal data
  • Delete personal data we have collected from you
  • Obtain a portable copy of your personal data
  • Opt out of the sale of personal data, targeted advertising, or profiling that produces legal or similarly significant effects
  • Opt out of the collection or processing of sensitive data
  • Opt out of the collection of personal data through voice or facial recognition (we do not knowingly do this)

Other U.S. residents. Depending on where you live, you may also have similar rights under your state's privacy laws. We honor verifiable consumer requests regardless of state when reasonably possible.

To exercise any of these rights, email us at the address in Section 10. We will verify your request and respond within the timeframe required by applicable law (generally 45 days). You will not be discriminated against for exercising your privacy rights.

8. Do Not Track and Global Privacy Control

Our Site does not currently respond to browser "Do Not Track" signals because no common standard has been adopted. Where required by law, we will treat recognized opt-out preference signals (such as Global Privacy Control) as a valid opt-out request from your browser.

9. Third-Party Links and Services

The Site may contain links to third-party services (YouTube, Instagram, Stripe, fulfillment partners, etc.). We are not responsible for the privacy practices of those services. Please review their policies before providing personal information.
